Analysis Shows Recalls Woefully Slow in Removing Potentially Contaminated Cannabis from Circulation

A recently conducted analysis has determined that most cannabis recalls are circulated too late, even when products contain unhealthy levels of pesticides or mold. This comes at a time when a growing number of people are raising concerns about product safety. The analysis focused on product recalls in the following state-regulated cannabis markets: New York, Michigan, Massachusetts, Colorado and California. CANNRA executive director Gillian Schauer said that states had different authority and capacity to recall products. The analysis determined that in some of these markets, recalls weren’t frequent, despite claims made by state authorities and whistleblowers that testing laboratories were…

Missouri Bans Sale of Delta-8 Intoxicants

The state of Missouri has placed a ban on the sale of candy, beverages and other edible products manufactured from intoxicating substances derived from hemp. Missouri is not the only state to regulate and/or impose a ban on delta-8 THC, with the move coming after the state’s governor Mike Parson issued an executive order on the same last week. The ban is set to go into effect from Sept. 1, 2024. In his order, the governor stated that lack of research on delta-8 THC and similar unregulated CBD compounds as well as health concerns were the basis for the ban.…

Latest NY Crackdown on Illicit Marijuana Outlets Starting to Stem the Vice

When the state of New York legalized adult-use marijuana, thousands of retail outlets started selling the substance without first obtaining licenses. These illegal establishments defied the authorities and remained open for more than a year due to lax enforcement. However, their luck turned when the state enacted new regulations in April. The office of the sheriff in New York City reveals that since the laws were strengthened in April, approximately 700 unlicensed cannabis shops have been closed. This success is largely attributed to the increased enforcement powers that local authorities were given in the new laws, and the opening of…

NTSB Writes to DEA Expressing Concerns about Marijuana Rescheduling

Earlier this month, the National Transportation Safety Board (NTSB) wrote to the U.S. Drug Enforcement Administration (FDA) highlighting its concerns regarding a rule that would reschedule marijuana under the Controlled Substances Act. The board explained that moving marijuana to Schedule 3 would prevent continued testing for cannabis use by transportation employees as labs certified by the U.S. Department of Health and Human Services (HHS) aren’t permitted to test for substances under this category. It implored the DEA to make sure that rescheduling cannabis didn’t compromise employee testing as this would have implications on the certification of school bus drivers. The…

States are Finding it Hard to Implement Eco-Regulations for the Cannabis Industry

Businesses in the cannabis industry, similar to other businesses, are required to comply with energy and environmental rules established by their respective states. Such rules may include how to adhere to standards on energy efficiency requiring specific lighting or HVAC equipment, or how to dispose of or treat wastewater. This industry’s huge impact on the environment, particularly the significant use of water and energy, is drawing the attention of regulators. This has prompted some states to enact cannabis-specific environmental regulations in response. States that have taken such action include Illinois, California, New York, Michigan and Massachusetts. A number of towns…

Congress Could Be Quickest Way to Reclassify Marijuana

Earlier this month, the United States Supreme Court thrust cannabis rescheduling into even deeper uncertainty. This comes after the court’s ruling directed that no deference be afforded to how federal agencies interpreted laws when Congress left room for ambiguity. This move may have increased the time it will take to reschedule marijuana because it offered new lines of attack to those what oppose the move. It is expected that the opposition could use the Loper v. Bright ruling, among other attacks, to hinder progress on rescheduling. This comes after President Joe Biden directed that the U.S. Department of Health and…

New Survey Shows Cannabis Could Reduce Prescription Analgesic Use

The state of Ohio legalized the medical use of cannabis in 2016, making it the 25th state in the country to do so. As of March 2024, the state had registered 167,153 patients who were legally allowed to use medical cannabis. Ohio’s medical cannabis program covers 26 eligible conditions, including post-traumatic stress disorder (“PTSD”) and chronic and intractable or severe pain, among others. The program permits cannabis to be sold as edibles, tinctures, oils, plant material and patches in 124 dispensaries across Ohio. Now, a recently conducted survey has discovered that the majority of medical marijuana patients have observed a…

State Cannabis Regulators Urge Feds to Provide Clarity Regarding Reclassification

The Cannabis Regulators Association (CANNRA) is requesting that the U.S. Drug Enforcement Administration and Biden Administration offer clarity on how rescheduling cannabis will affect enforcement by the federal government, particularly in legal states. In a public comment to the DEA’s administrator Anne Milgram, CANNRA leaders explained that without federal guidance, territorial and state government agencies would be left guessing and hypothesizing about these dynamics and their possible effects on legal programs regulated by states, and the populations impacted by these programs in various jurisdictions, among other things. CANNRA is an organization that represents hemp and cannabis regulators in more than…

Did Congress Inadvertently Legalize Marijuana in 2018?

Congress federally legalized hemp when it approved the 2018 Farm Bill, making the use of hemp as well as its production legal. Legislators who supported the legalization of this industrial crop expected that it would be used for textiles and nonintoxicating supplements such as shelled hemp seeds and CBD oil. What they didn’t realize, however, was that with some tweaking, hemp could also induce highs when consumed. Currently, individuals in different parts of the country can get high on THC derived from hemp without breaking the law. These hemp-based intoxicants are every bit as strong as compounds derived from cannabis…

Delaware Starts Prepping for Adult-Use Cannabis Market Launch

Last month, legislators in Delaware approved a measure that would allow medical cannabis licensees in the state to apply for conversion licenses to cultivate and sell recreational marijuana. Governor John Carney is expected to sign the measure in the coming weeks. The recently approved measure was sponsored by Representative Ed Osienski, who revealed that cultivation was the most difficult pathway to use to enter the marijuana industry. This, Osienski explained, was because of the larger investments needed to cover the needed infrastructure, such as ventilation and lighting as well as the need for more time for cultivation. This was why…
