The DEA has granted federal registration to over 900 medical marijuana dispensaries operating in seven states, marking an early step in the federal government’s overhaul of cannabis policy, Department of Justice officials announced on Friday.
The registrations follow the Trump administration’s decision in April to move medical cannabis from Schedule 1 to Schedule 3 under federal law. The DOJ described the latest action as the first stage of a broader transition for businesses serving state-licensed medical marijuana patients.
Todd Blanche, the Attorney General, said the registrations could expand access to cannabis-based treatment for people dealing with chronic pain while adding federal oversight intended to protect public safety. He also stressed that federal authorities would continue pursuing cases involving illicit cannabis distribution and other related offenses.
The policy change does not apply to every form of cannabis. Cannabis outside the scope of the April order remains classified under Schedule 1, according to the department. Recreational marijuana also remains in that category while a separate federal review continues, with no firm completion date announced.
The DEA said the newly registered dispensaries are located in West Virginia, Alabama, Virginia, Florida, Texas, South Dakota, and Mississippi. Federal officials said applications came from businesses that met specified requirements during an initial 60-day filing period that ended June 26.
Among the conditions were providing employee information and undergoing preliminary investigations by DEA personnel. The agency did not identify individual companies receiving registrations.
Questions remain over exactly how the registrations will affect individual businesses. The DEA has separately warned operators that they must take care when working with companies that have not sought federal registration.
According to agency guidance, businesses that received registration or submitted applications during the designated filing period cannot conduct certain Schedule 3 medical marijuana transactions with entities that did not apply. Companies are being advised to confirm their partners’ application status and retain copies of relevant filings.
A limited exception applies when small quantities are supplied to state-approved laboratories that have yet to obtain DEA registration.
Businesses with pending applications have until Nov. 29 to bring their supply arrangements into compliance, the agency said. Failure to follow the rules could result in an application being rejected or an existing registration being withdrawn.
The DEA is still reviewing additional applications from dispensaries, processors, and manufacturers. Those cases may require production oversight, facility inspections, and decisions involving federally controlled quotas before approval is granted.
As this ongoing process pans out, many cannabis companies, such as Cresco Labs Inc. (CSE: CL) (OTCQX: CRLBF), will be looking out for the concrete benefits that registering with the DEA brings to industry actors.
