420 with CNW — Delaware Lawmakers Override Gov. Meyer’s Veto on Marijuana Law

Delaware lawmakers have completed the process of turning Senate Bill 75 into law after the state House voted on July 1 to override Governor Matt Meyer’s veto. The measure cleared the chamber by a 25-16 vote, marking the final legislative step needed to enact the proposal following an earlier override by the Senate.

The legislation is designed to limit the ability of county governments to impose zoning rules that supporters argue could block or severely restrict licensed marijuana businesses. Backers of the bill say the changes are intended to expand access to the state’s regulated cannabis market while ensuring businesses can operate under consistent statewide standards.

Governor Meyer rejected the proposal last August after it was approved by lawmakers. In his veto message, the governor expressed concern that the bill would weaken the authority of local governments to make decisions about land use within their own communities.

Meyer said he remained committed to developing a legal recreational cannabis market that is safe, fair, and accessible. However, he argued that limiting local control without providing additional collaboration or resources would not create lasting policy or strengthen public confidence in the process.

The state Senate voted to override the governor’s veto in January, leaving the House to complete the final step. Representatives did so during the early hours of July 1, just before the General Assembly concluded its legislative session.

Representative Ed Osienski, the House sponsor of SB 75, welcomed the outcome, saying lawmakers had consistently sought to establish a regulated cannabis market that protects public safety while supporting legitimate businesses.

According to Osienski, that objective became increasingly difficult after counties introduced zoning restrictions that he believes conflicted with the goals of the Delaware Marijuana Control Act and made it nearly impossible for licensed cannabis retailers to open.

Not everyone supported the timing of the vote. Representative Shannon Morris questioned why House leaders waited several months after the Senate acted before bringing the override to the floor. Morris also noted that the vote occurred only a short time before lawmakers adjourned for the year.

Osienski responded by pointing to a ruling issued by the state Supreme Court in May. He said the decision confirmed that zoning authority ultimately belongs to the General Assembly and that local governments may exercise only the powers granted to them by state lawmakers. According to Osienski, the court’s interpretation gave House members greater confidence to proceed with overturning the governor’s veto.
